General Terms and Business Conditions
1. General1.1. For any business deal between customer and Cateringkultur GmbH, Heiligenstädter Straße 103 - 105, A-1190 Wien, (in the following called Cateringkultur GmbH) these "General terms and conditions” are exclusively valid. Conflicting business terms of the customer are only effective when acknowledged explicitly and in written form by Cateringkultur GmbH.
1.2. Agreements deviating from or supplementing these „General terms and conditions" have to be made in writing.
1.3. If singular parts of these „General terms and conditions" become invalid, the binding character of the other parts and also contracts based on them will not be touched. The invalid part will have to be replaced by a valid termin, which comes as close as possible in sense and purpose.
2. Range of products
Our extensive range of products underlies seasonal changes. If particular articles are momentarily not available, they will be replaced by at least equivalent products.
3. Delivery
3.1. Accepted catering dates can only be kept by Cateringkultur GmbH under the prerequisite of a normal operation. Strike, acts of God, massive technical breakdowns, i.e. electricity breakdowns, release us from our obligations.
3.2. Eventual complaints about the catering have to be announced immediately (if possible at the event), at least within 3 days after the event by the customer. Otherwise we assume that our work is accepted by the customer. Cateringkultur GmbH does not take any responsibility for the improper storing by the customer.
3.3. The duty of care for rented items lies in the responsibility of the customer from taking it over until return. Eventual damages or loss have to be covered by the customer. For damages which have been verifiably caused by the fault of Cateringkultur GmbH, Cateringkultur GmbH will be liable (resp. their company liability insurance)
4. Terms of cancellation
4.1. After the placement of an order until 14 days before the event 20 % of the ultimate offer will be charged in case of cancellation.
4.2. In case of cancellation up to 3 days before the event 70% of the ultimate offer will be charged.
4.3. In case of cancellation within 3 days of the event 100% of the ultimate offer will be charged.
5. Terms of payment
5.1. The invoice amount is payable within 10 days without discount.
5.2. All claims, including those resulting from this invoice, are transferred to INTERMARKET BANK AG. Therefore payments can only be made to this company in favour of Account Nr. 403 326 747 00, Erste Bank AG, BLZ 20111 (BIC/SWIFT: GIBAATWW, IBAN: AT842011140332674700).
5.3. The customer is not entitled to restrain his payments due to incomplete work or criticism. The customer is only allowed to charge up against undisputed or sentential claims.
6. Court of jurisdiction
The court of jurisdiction for any direct or indirect diputes between Cateringkultur GmbH and the customer is the Commercial Court of Vienna. Cateringkultur GmbH is furthermore entitled to take legal action at another court, which is competent for the customer.
